These terms apply to orders placed on kulana.fr, kulana.eu and kulana.us.
1. Products
KULANA sells swimwear, clothing and fashion accessories.
The essential characteristics of each product, including its size, composition, fit and price, are provided on the relevant product page.
We make every effort to display our products and their colors as accurately as possible. However, slight color differences may occur depending on the screen or device used.
Products are offered subject to availability.
2. Prices
The applicable prices are those displayed on the website at the time the order is placed.
Prices, taxes and currencies displayed may vary depending on the country or region of delivery.
Applicable shipping costs are displayed before the order is finalized.
For certain international destinations, customs duties, import taxes or other charges may be imposed by local authorities. Where these charges are not included in the price paid at checkout, they remain the customer's responsibility.
3. Orders
Customers select the products they wish to purchase and can review the contents of their order, its price and the information provided before proceeding with payment.
Placing an order constitutes acceptance of these General Terms and Conditions of Sale.
An order confirmation is sent to the email address provided when placing the order.
KULANA may refuse or cancel an order for legitimate reasons, including payment issues, suspected fraud, product unavailability or an obvious error relating to the price or product information.
If an order that has already been paid for is cancelled by KULANA, the corresponding amount will be refunded.
4. Payment
Payment is due at the time the order is placed.
Available payment methods are displayed during checkout and may vary depending on the country or region.
Transactions are processed by secure payment service providers.
5. Delivery
Orders are generally dispatched within 48 business hours. During busy periods, particularly peak season, sales or new collection launches, processing times may be slightly longer.
France

Colissimo: 24 to 72 business hours

Mondial Relay: 3 to 5 business days
For other countries, delivery times may vary depending on the destination.
Within Europe, delivery generally takes approximately 3 to 4 business days with Colissimo and approximately 6 business days with Mondial Relay, which is a more economical shipping option.
For destinations outside Europe, delivery times vary depending on the country. An estimated delivery time is provided when selecting the shipping method.
For faster delivery, we recommend choosing Colissimo.
Delivery times provided by carriers are estimates and may be affected by circumstances beyond KULANA's control.
The customer is responsible for ensuring that the delivery address provided when placing the order is accurate and complete.
6. Right of Withdrawal and Returns
Consumers have 14 days from receipt of their order to exercise their right of withdrawal, in accordance with applicable regulations.
All return requests must be submitted through the contact form available on our website.
Before any item is returned, a photo check is required to verify its condition. Once approved, a return label will be provided to the customer.
Returned items must be unused, in the same condition in which they were received and in their original packaging. Any product that is damaged or shows signs of wear cannot be refunded, subject to applicable statutory guarantees.
Any protective coverings and labels attached to the swimwear must remain in place when trying on and returning the item.
KULANA does not offer exchanges. If you would like a different size or model, you may return the relevant item for a refund and then place a new order.
7. Return Shipping Costs and Refunds
Return shipping costs are the customer's responsibility, except where applicable law requires KULANA to cover them.
Where KULANA provides a return label, its cost will be deducted from the refund amount.
Once the return has been received, inspected and approved, the refund will be issued to the original payment method.
The time it takes for the refund to appear in the customer's account will then depend on their bank or payment service provider.
If a return causes the value of the remaining order to fall below the free shipping threshold, the original shipping costs that were initially waived may be deducted from the refund where permitted by applicable law.
8. Defective or Non-Conforming Products
If a product received is defective, damaged or does not match the order, the customer must contact KULANA through the contact form, providing their order number and, where possible, photographs of the product concerned.
This procedure does not limit the consumer's rights under applicable statutory guarantees.
9. Statutory Guarantees
Products sold by KULANA are covered by the statutory guarantee of conformity provided for under the French Consumer Code and the statutory guarantee against hidden defects provided for under the French Civil Code.
These statutory guarantees apply independently of KULANA's commercial return policy.
10. Personal Data
Personal data collected in connection with an order is processed in accordance with our Privacy Policy.
11. Intellectual Property
KULANA's trademarks, logos, photographs, creations, designs, models, texts and other content are protected by applicable intellectual property laws.
Any unauthorized reproduction, representation or use is prohibited, except where permitted by law.
12. Liability
KULANA shall not be held liable for any delay or failure to perform resulting from an event of force majeure or circumstances reasonably beyond its control, within the limits permitted by applicable law.
Nothing in these General Terms and Conditions of Sale shall limit any mandatory rights granted to consumers under applicable law.
13. Complaints and Dispute Resolution
In the event of an issue relating to an order, customers are encouraged to contact KULANA in order to seek an amicable solution:
Consumers may also have access to a consumer mediator free of charge under the conditions provided by applicable law, after first submitting a written complaint to KULANA.
14. Governing Law
These General Terms and Conditions of Sale are governed by French law.
Where a consumer resides in another country, this provision does not deprive them of any mandatory consumer protection rights available under the laws applicable in their country of residence.
15. Changes to the General Terms and Conditions of Sale
KULANA may amend these General Terms and Conditions of Sale, in particular to reflect changes in its business activities or applicable regulations.
The General Terms and Conditions of Sale applicable to an order are those in force at the time the order is placed.
